Terms of Service
Last updated 17 October 2026. Effective 17 October 2026.
1. Acceptance of these terms
These terms are an agreement between you and SafePod (“SafePod”, “we”, “us”) governing your use of the SafePod platform and website (the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service. How your data is handled is described in the Privacy Policy, which forms part of these terms.
If you are using the Service on behalf of an organisation, you confirm that you are authorised to accept these terms for that organisation, and “you” means that organisation.
2. A hosted service, in early access
SafePod is a hosted service. We operate it for you on Google Cloud in the United States; we do not offer a self-hosted, on-premises or privately deployed edition, and these terms cover only the service we run.
The Service is in early access. It is provided as-is, availability is not guaranteed, features may change or be withdrawn, and planned or unplanned interruptions should be expected. There is no service level commitment, and SafePod has not completed an independent third-party security certification.
Keep your own backups. Do not use SafePod as the only copy of anything you cannot afford to lose.
We may add, change, suspend or remove features at any time. Where a change materially reduces functionality you rely on, we will give reasonable notice where circumstances allow.
3. Eligibility and your account
You must be at least 16 years old to use the Service. You are responsible for your account and for everything done through it, including the acts of any agent you run. Keep your sign-in credentials secure, do not share your account, and tell us promptly at [email protected] if you believe your account has been compromised.
4. Fees
SafePod is a commercial product. During early access the Service is provided free of charge, and we intend to introduce paid plans. We will give you notice before any charge applies to your account, and you may decline by discontinuing use before the change takes effect. Free access during early access does not create a right to continued free use.
When paid plans begin, fees, the billing period and the refund position will be stated at the point of purchase and form part of these terms. Fees are exclusive of taxes, which you are responsible for where they apply. Separately, you remain responsible for any charges you incur directly with third parties — model providers and connected services bill you under their own terms, not ours.
5. Your content
You keep all rights to the files, prompts and other content you bring to or create in the Service (“Your Content”). You grant SafePod only the licence it needs to operate the Service for you: to store your workspaces, run your agents, transmit your requests to the model provider you chose, and show your work back to you. This licence is non-exclusive, worldwide and royalty-free, lasts only as long as we hold the content for you, and ends when you delete it.
SafePod does not use Your Content to train machine-learning models, and does not sell it. You are responsible for having the rights to the content you bring, and for ensuring it does not break the law or infringe anyone else's rights.
6. Feedback
If you send us suggestions, bug reports or other feedback, you grant us a perpetual, irrevocable, royalty-free right to use it to improve the Service, without obligation or attribution. You are not required to send feedback.
7. SafePod's intellectual property
The Service, its software, its design and the SafePod name and logo are owned by SafePod and are protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service as it is provided. They do not transfer any ownership to you, and you may not copy, modify, reverse-engineer, resell or create derivative works from the Service except where that restriction is unenforceable under applicable law.
8. Credentials and third-party services you connect
You decide which model providers and connectors to add, and you are responsible for having the right to use the credentials and accounts you connect. Your use of those third-party services remains governed by their own terms, and SafePod is not responsible for their behaviour, availability, pricing, or any charges you incur with them. Disconnecting a service in SafePod deletes our stored credential but does not revoke the grant at the provider — see the Privacy Policy for how to complete that.
SafePod keeps your credentials out of the agent sandbox and encrypted at rest, as described in the Privacy Policy. That is a meaningful protection, not a guarantee against every possible compromise.
9. Agents act on your instruction
An agent is an automated system acting on instructions you give it, with the permissions you grant it. Its output can be wrong, and it can take actions you did not precisely intend — including creating or overwriting files, posting messages through a chat connector you enabled, or making changes in a connected service. You are responsible for the permissions you grant and for reviewing what an agent produces before relying on it. Grant the narrowest set of actions that does the job.
Do not rely on agent output as professional advice, and do not use the Service where an incorrect or unreviewed automated action could endanger health, safety, or legal rights.
10. Acceptable use
You must not use the Service to:
- break the law, or infringe anyone's rights;
- attack, probe or disrupt SafePod's infrastructure, or attempt to escape the sandbox boundary or reach another user's data;
- access accounts, mailboxes or files you are not authorised to access;
- send spam or bulk unsolicited messages through a connector;
- mine cryptocurrency, run unrelated general-purpose hosting, or otherwise consume resources in a way unrelated to agent work;
- build or operate anything designed to harm people, including surveillance of individuals without their consent, or the creation of malware intended for unauthorised use;
- circumvent the limits, quotas or permission boundaries of the Service.
Security research against your own account is welcome. Tell us what you find at [email protected] before disclosing it publicly, and give us a reasonable opportunity to fix it.
11. Suspension and termination
You can stop using the Service and delete your account at any time from settings. We may suspend or terminate an account that breaches these terms, that puts the Service or other users at risk, or where required by law. Where circumstances allow, we will give notice and an opportunity to export your work; where a breach is causing active harm, we may act first and notify afterwards.
On termination, your right to use the Service ends and your data is deleted as described in the Privacy Policy. Sections 5 to 7 and 12 to 16 survive termination.
12. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy of output, and uninterrupted or error-free operation. You use the Service at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, SafePod is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, loss of business, or lost or corrupted data, whether or not we were advised such damages were possible. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid for the Service in the three months before the claim, or USD 100.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, for death or personal injury caused by negligence, or any statutory consumer rights you have that cannot be waived.
14. Indemnification
You agree to indemnify and hold SafePod harmless from any third-party claim, loss or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, the instructions you give an agent, the permissions you grant it, or your breach of these terms. This does not apply to the extent the claim arises from our own breach of these terms.
15. Export control and sanctions
The Service is operated from the United States and is subject to United States export control and sanctions law. You confirm that you are not located in, and are not ordinarily resident in, a country or region subject to comprehensive sanctions, and that you are not on any applicable restricted or denied party list.
16. General
- Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the Service, and replace any earlier understanding about it.
- Severability. If any provision is found unenforceable, it is modified to the minimum extent necessary, and the rest stays in force.
- No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
- Assignment. You may not assign these terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
- Force majeure. Neither party is liable for a failure to perform caused by events beyond its reasonable control.
- Notices. We may give notice by email to the address on your account, or by posting in the Service. You can reach us at the address in section 18.
- No third-party beneficiaries. These terms create rights only for you and SafePod.
17. Changes to these terms
We may update these terms. If a change materially affects your rights we will update the date above and notify account holders by email before it takes effect. Continuing to use the Service after that point means the updated terms apply. If you do not accept a change, stop using the Service and delete your account.
